Super Micro-Linked Contractor Admits Role in Alleged $2.5 Billion AI Server Diversion to China
A contractor linked to US server manufacturer Super Micro Computer has pleaded guilty in a case involving an alleged scheme to divert approximately $2.5 billion worth of advanced artificial intelligence technology to China in violation of US export control laws.
Ting-Wei “Willy” Sun entered his guilty plea on October 8 in the US District Court for the Southern District of New York, according to court records and a Reuters report published on October 9.
Prosecutors allege that Sun worked with two other individuals associated with Super Micro to arrange the shipment of servers containing advanced Nvidia AI chips to China without the required export licences. The alleged scheme involved using an intermediary company in Southeast Asia to conceal the ultimate destination of the equipment.
The case highlights Washington’s efforts to restrict China's access to advanced computing technology that US authorities consider strategically important for artificial intelligence development and national security.
How the Alleged $2.5 Billion Scheme Worked
According to the US Department of Justice, the alleged scheme involved orders for approximately $2.5 billion worth of servers between 2024 and 2025. The equipment was manufactured or assembled in the United States and included advanced AI computing technology subject to export restrictions.
Investigators allege that the participants used a Southeast Asian company as an intermediary, presenting it as the intended end user while arranging for the equipment to reach customers in China.
The indictment also describes an alleged effort to mislead compliance officials and inspectors. Prosecutors say the participants staged non-working “dummy” servers during inspections to make it appear that the actual equipment remained in approved locations, even though some servers had allegedly already been diverted.
The US government said at least approximately $510 million worth of servers were allegedly redirected to China during a period between late April and mid-May 2025.
Nvidia AI Chips at the Centre of the Case
The servers allegedly involved in the scheme contained advanced Nvidia graphics processing units, including the B200, H100 and H200 models, according to the indictment.
These processors are designed for demanding computing workloads, including training and running sophisticated AI models. Their computing capacity has made advanced AI chips a focus of competition between the United States and China.
US export controls require licences for certain advanced computing products destined for China. Authorities argue that restricting access to such technology is important to protect national security and prevent sensitive computing capabilities from reaching prohibited end users.
The charges concern the alleged unlawful export of servers and related technology, rather than a claim that Nvidia itself was involved in the diversion scheme.
Two Other Individuals Were Also Charged
Sun was charged alongside Yih-Shyan “Wally” Liaw, a Super Micro co-founder, and Ruei-Tsang “Steven” Chang, who worked as a sales manager at the company's Taiwan office.
The US Department of Justice announced the charges in March 2026. The defendants were accused of conspiring to violate export control laws, smuggle goods and defraud the US government.
Sun’s guilty plea marks a significant development in the case. The legal status of each defendant must be considered separately: a guilty plea by one person does not establish the guilt of the other accused individuals.
Super Micro Says It Is Not a Defendant
Super Micro has said it was not named as a defendant in the criminal indictment. The company previously stated that it had terminated Sun and ended its relationships with the other individuals involved, according to Reuters.
The allegations have drawn attention to the challenges technology manufacturers face when monitoring the final destinations of sophisticated computing equipment sold through international distributors and intermediary businesses.
The company’s position is distinct from the criminal allegations against the individuals. Any further legal consequences will depend on the proceedings and evidence in court.
Why the Case Matters for the AI Industry
The case underscores how AI hardware has become a central issue in US-China technology relations. Advanced processors and servers are essential infrastructure for developing powerful AI systems, and governments increasingly view access to them through a national-security lens.
For technology companies, the case also highlights the importance of export compliance, customer verification, supply-chain oversight and accurate end-user documentation.
The proceedings are expected to remain under scrutiny as the court considers the consequences of Sun’s plea and the cases involving the other defendants.
