Former OpenAI Engineer Held Without Bail as US Court Cites Flight Risk

A US federal judge has ordered former OpenAI engineer Abdulrahman Alfozan to remain in custody without bail while he awaits trial over allegations that he secretly installed an audio-recording device in a confidential executive meeting room at the artificial intelligence company’s San Francisco office.

The ruling was issued on Monday, October 19, after prosecutors argued that Alfozan posed a significant flight risk because of his alleged plans to move to Saudi Arabia and his reported connections with individuals there. His defence had requested his release under conditions designed to ensure he appeared in court.

Alfozan, 35, is a Saudi national who previously worked as an engineer at OpenAI. He has been charged with attempting to intercept oral communications using an electronic device. He is presumed innocent unless proven guilty in court.

Why the Judge Ordered Continued Detention

Prosecutors argued that Alfozan had the financial resources and external support that could make it easier for him to leave the United States. Court filings also described his alleged communications with an unnamed member of the Saudi royal family and discussions about a possible role in an artificial intelligence initiative in Saudi Arabia.

The government further pointed to travel arrangements involving Alfozan’s family. According to the prosecution’s account, his wife and young son travelled to Saudi Arabia after his arrest, with tickets allegedly paid for by a Saudi military official.

The defence proposed conditions for release, including electronic location monitoring and surrendering his passport. However, the judge concluded that the proposed arrangements did not sufficiently address the risk that Alfozan might fail to appear for future proceedings.

The court’s detention decision concerns whether the defendant should remain available for trial; it is not a finding that the criminal allegations have been proved.

What Prosecutors Allege Happened at OpenAI

According to the criminal complaint, OpenAI employees discovered a concealed recording device on September 30 in a USB port at the back of a television in an executive conference room at one of the company’s San Francisco buildings.

Investigators alleged that the device had been installed around September 28 and was concealed in a way intended to avoid detection. The room was reportedly used for discussions involving confidential technical research, product plans, commercial strategy and business relationships.

The complaint also describes evidence gathered from office surveillance footage and digital inquiries that investigators believe may be connected to the alleged recording device. Prosecutors have said the investigation remains active and that additional charges could be considered.

These claims are allegations contained in court documents. The evidence and the defendant’s response will be subject to the legal process.

Saudi Connections Become a Central Issue

The case has drawn attention to the reported relationship between the former engineer and contacts in Saudi Arabia. Prosecutors cited messages they say show that a member of the Saudi royal family encouraged Alfozan to return to the kingdom for an AI-related opportunity.

They also argued that the alleged support offered for his release raised questions about whether a financial bond would be enough to ensure his continued presence in the United States.

Alfozan’s lawyer, meanwhile, has pointed to his long period of residence in the country and his application for US citizenship. The defence has challenged the need for continued detention and sought a conditional release.

The allegations about outside support and the purpose of the communications have not been established as facts through a trial.

OpenAI and the Investigation

OpenAI discovered the device and referred the matter to the FBI, according to information released by the company and federal authorities. The company subsequently terminated Alfozan’s employment.

OpenAI has also said it had no indication that the individual improperly accessed or removed model weights, source code or customer data. That distinction is important: the alleged interception of conversations is the central criminal accusation, and the publicly described evidence does not by itself establish that proprietary AI data was stolen.

The investigation is taking place amid wider concerns about protecting sensitive AI research, confidential corporate meetings and technology development from insider risks.

What Happens Next?

Alfozan remains in federal custody as the case proceeds. Prosecutors must establish the allegations through the criminal justice process, while the defence will have an opportunity to contest the evidence.

If convicted of the charged offence, he could face a maximum sentence of five years in prison and a fine of up to $250,000, according to the US Justice Department. The maximum statutory penalty is not a prediction of the sentence he would receive.

The case could also draw further scrutiny to security procedures at major AI companies, particularly how they protect confidential meetings and investigate suspected insider misconduct.
